Envision Terms of Use

Our Service: The provision of a website, which may include, but is not obliged to include, the following facilities:

  • information about Envision and our past, present and planned activities;
  • facilities where you can post information (including text and photographs) about your school's Envision Team's activities, interests and projects;
  • access to our Blog where you can contribute your views on topics being discussed .


Envision Registration: Your membership of Envision and registration to use the Envision Website is personal to you only. You may not transfer your registration to anyone else without our prior written consent. We reserve the right to change the basis on which registration is offered or to terminate your registration if we feel it is appropriate to do so.

 

Use of the Service: You may only use the Envision Website in accordance with the instructions appearing on the Envision Website (including these Terms of Use) for your own personal use or for that of your school's Envision Team. You may not use, reproduce, adapt, modify or otherwise make available for any other purpose:

  • any text, information, data, images, software or other materials constituting or contained in the Envision Website; or

  • the structure and layout of the Envision Website, including, the architecture of any pages or series of pages or any links to other website.

 

Password: You must keep the password we give you or any password which you choose subsequently secret and confidential. We will hold you responsible for all use of the Envision Website using your password. You should tell us or change your password if you think someone else knows it. You will indemnify us and hold us harmless against any loss we may suffer arising out of the unauthorised use of your password.

 

Warranty: We do not guarantee that the Envision Website will operate according to any specification or description and that the Service and/or the Envision Website will be uninterrupted or error free. We do not warrant that the Website or any related software or hardware are free from viruses or other harmful components.

 

Content and Materials: The information and materials constituting or contained in the Envision Website are owned by us or our licensors. You do not obtain any rights in and to such information and materials other than as expressly set out in these Terms of Use.

 

We do not warrant that any information obtained from or via the Envision Website is correct, accurate, reliable or available for your unrestricted use.

 

We are not responsible for the contents or reliability of any other websites to which we provide a link and do not necessarily endorse the views expressed within them.

 

You are responsible for any content, materials or information you store or upload to the Envision Website or allow to be stored or uploaded (including, for example, where a third party obtains your password). You must comply with any relevant laws and regulations relating to such activities or information, including, for example, intellectual property rights, defamation, data protection or any regulation of obscene, offensive or illegal content. You will indemnify us and hold us harmless against any loss we may suffer as a result of your breach or any alleged breach of any such law or regulation by any third party.

 

By positing or uploading any content, materials or information to the Envision Website you grant Envision permission to:

•  use, modify, copy, distribute, transmit, publicly display, perform, reproduce, publish, sub-licence, create derivative works from, transfer, or sell any such material;

•  sub-licence to third parties the unrestricted rights to exercise any such rights granted with respect to your material.

 

We reserve the right to access any information stored on or via the Envision Website and remove all or any part of such information if we deem it to be actually or potentially inappropriate, tasteless, obscene, defamatory or illegal. However, we shall be under no obligation to monitor any such information or content.

 

Liability: We make no warranties whatsoever as to the quality or operation of the Envision Website, the services or any information or other material obtained from or via the Envision Website and all implied warranties, representation and conditions are hereby excluded to the fullest extent permitted (other than misrepresentations made fraudulently).

 

We are not liable to you for any loss or damage resulting from our provision of the Services or your use of the Envision Website, including in relation to negligence. In any event, your sole remedy against us is to discontinue to use the Envision Website, which you may do at any time.

 

Governing Law: These Terms of Use are governed by the laws of England and Wales . If any provision in these Terms of Use is held to be invalid or unenforceable then the remainder of these Terms of Use shall remain valid and enforceable according to their terms.



 

User Generated Content

Users of the Envision website are able to upload materials, including but not restricted to images, video footage, text and information (“User Generated Content”).You agree to use the Website only for lawful purposes and upload User Generated Content in a manner that does not infringe the rights of anyone else, nor restrict or inhibit their use of the Website.

  • You must not post or upload any User Generated Content to the Website that breaches any law, whether criminal, tortious or otherwise or that is offensive, threatening, defamatory, vulgar, obscene, harassing, false, misleading or unreliable, or that brings or is likely to bring the Website, Envision or its name into disrepute.

  • You agree to only contribute User Generated Content to the Website in which you retain all the necessary ownership rights and intellectual property rights and that do not infringe any third party rights (including rights of privacy or publicity).

  • You will indemnify Envision against all proceedings, actions, damages, legal costs (including but not limited to legal costs and disbursements on a solicitor and client basis) expenses and any other liabilities arising from the use by Envision of any material or User Generated Content you post to the Website which involves any infringement or alleged infringement of the intellectual property rights, ownership rights or any other rights (including rights of privacy or publicity) of any third party.

  • Using your access to the Website to send unsolicited bulk email or spam to other users or place material on the Website for your own business or commercial purposes is forbidden.

  • We reserve the right to edit, or require you to edit, material posted by you on the Website if it is deemed by us to be in breach of these Terms and Conditions.

  • Anything you post or transmit to the Website may be used by Envision for any purpose, including but not limited to reproduction, disclosure, transmission, publication, broadcasting and posting of your User Generated Content. Envision is free to use any ideas, concepts, know-how, or techniques contained in any communication you send to the Website for any purpose whatsoever.

  • You grant other users of the Website a non-exclusive licence to view your User Generated Content through the Website subject to these Terms and Conditions.

  • You are wholly responsible for all materials posted on the Website using your user name and email address.

  • We reserve the right to suspend or terminate your access to the Website immediately if materials posted by you on the Website are deemed by us to be in breach of these Terms and Conditions.

 


 

Envision Blog Terms

The following guidelines are for everybody's benefit. By posting messages on Envision Blog’s, you agree to use the Envision Blog only to facilitate the sending and receiving of messages and materials that are proper and related to the particular topic being discussed. The following is a non-exhaustive list of guidelines that you should follow when using the Envision Blog.

  • Do not use inappropriate user names (i.e. names that are vulgar or offensive). We will delete your user name and password if you do.

  • Do not reveal personal information about yourself (i.e. telephone number, home address, or email address) in any of the postings you make to the Blog. If there are contact details you would like to share then contact the Envision website co-ordinator: webmaster@envision.org.uk.

  • Be courteous at all times, posting abusive, obscene, threatening, harassing, defamatory, libelous or sexually explicit material or any material that is found to be offensive is not acceptable and we may suspend your user name and password.

  • Retaliating to offensive posts causes more problems for other users on the discussion boards. Just report such messages to the Envision Website co-ordinator: webmaster@envision.org.uk . We will act on every report we receive.

  • Offering to buy or to sell any goods or services or using the Blogs to advertise any product or service is prohibited.

  • Please respect other people's work and do not post material that infringes other's copyright or other intellectual property rights.

  • Do not post information that you know to be confidential or sensitive or otherwise in breach of the law. You should only post material that you know to be public knowledge. If you have any doubts do not post it on the site.

  • Always try and keep your messages relevant and 'on topic'.

  • Never attempt to gain unauthorised access to any area of the Envision Website. This is known as hacking. It is also illegal.

Please be AWARE of the following:

  • The details you supply and all messages are recorded and kept, including your originating IP address and this information may have to be disclosed to any regulatory or criminal authority or third party.

  • We will accept no responsibility for information posted on the blog.

  • If we receive notice that any posting or your intended use of the discussion boards is not in keeping with these Blog Forum Terms, we may remove that posting and/or any other related postings and/or disable your username and password and take all such steps as may be necessary to protect our position.

  • We exercise any form of editorial control or censorship of any message on the discussion boards.

Our Privacy Policy

Data Protection: We do not collect personally identifiable information from people entering the public areas of the Envision Website (i.e. those areas where we have not asked you to login). All we do is gather aggregated data relating to the useage of the Envision Website (i.e. number of visitors). We may also record the location of your computer on the Internet.

 

Once you have registered to use the Envision Website we will collect and store your registration details. We will only use this information to operate and enhance our Service to you.

 

We may send you emails with information about Envision and the Envision Website. Unless we obtain your consent first, we will not use your personal information to market goods and services of third parties nor will we disclose your personal information to third parties for this purpose. We may disclose your personal information, where we are required to do so by law or by a regulator or law enforcement agency.
